What does a landlord need to participate in Section 8?

Housing Choice Voucher participation involves more than simply agreeing to accept a voucher. The property, proposed rent, landlord paperwork and tenancy must satisfy applicable Housing Choice Voucher requirements.

The local Public Housing Agency is your operating authority. Learn its procedures before you purchase or promise a property based on voucher income.

Think of landlord participation in six parts.

Exact PHA requirements vary, but these are the major areas a prospective Housing Choice Voucher landlord should expect.

Landlord Paperwork

These are some of the major forms you may encounter.

HUD has standard forms, but local PHAs may also require additional forms based on their own administrative procedures.

Request for Tenancy Approval

Often called the RFTA.

The household gives this form to the landlord. The landlord completes the required information and returns it to the PHA to begin the tenancy-approval process.

HAP Contract

HAP means Housing Assistance Payments.

The HAP contract governs the relationship between the landlord and the PHA for housing assistance payments.

Tenancy Addendum

The HUD tenancy addendum is attached to the rental lease.

Where the tenancy addendum conflicts with a provision in the ordinary lease, the HUD addendum generally controls for the covered subject.

IRS Form W-9

Taxpayer Information

The PHA generally needs landlord taxpayer information so housing assistance payments can be properly reported.

  • Taxpayer identification number
Street Smart Rule Do not assume the HUD forms are the entire application package. Contact the actual PHA serving your property and obtain its current landlord packet, forms, payment instructions, inspection requirements and administrative procedures.
Owner Information

Be prepared to document who owns the property and where payments should go.

Identity Provide the landlord or ownership information required by the PHA.
Tax Information Complete applicable taxpayer documentation, commonly including Form W-9.
Payment Information Provide the PHA with the information needed to make housing assistance payments.
Ownership A PHA may request documents supporting ownership or authority to lease and manage the property.
Management If a management company is involved, additional documentation may be required.
Local Forms Individual PHAs can require additional certifications and landlord documentation.
The Property

The landlord is not the only thing being approved. The unit matters too.

The unit must satisfy the inspection requirements that apply to the PHA's Housing Choice Voucher program.

Make the Unit Available

The landlord must cooperate with the PHA's inspection process.

Correct Deficiencies

Conditions identified through inspection may need to be corrected before or during continued program participation.

Maintain the Property

Participation does not eliminate ordinary maintenance and housing-condition responsibilities.

Current inspection transition HUD is transitioning Housing Choice Voucher inspections from HQS toward NSPIRE. PHAs may continue using HQS or another HUD-approved inspection method through January 31, 2027, with federal NSPIRE compliance beginning February 1, 2027. Always verify the current procedure with the PHA serving your property.
Rent Approval

The landlord proposes the rent. The PHA still has to approve it.

The proposed rent must satisfy applicable Housing Choice Voucher requirements, including rent reasonableness.

Proposed Rent

The landlord identifies the rent being requested for the unit.

Comparables

The PHA compares the proposed rent with similar unassisted rental units.

Reasonable Rent

The PHA must determine the rent is reasonable before executing the HAP contract.

Do not confuse payment standard with approved rent. A payment standard is part of the subsidy calculation. It does not mean that a landlord may automatically charge that amount for every property of that bedroom size.
Two Relationships

You have a tenant relationship and a PHA relationship.

Landlord ↔ Tenant

Rental Lease

The lease establishes the landlord-tenant rental relationship, together with applicable law and the HUD tenancy addendum.

Landlord ↔ PHA

HAP Contract

The Housing Assistance Payments contract governs the PHA's subsidy payments to the landlord.

After Move-In

Approval is not the end of the landlord's responsibilities.

Maintain

Keep the property in the condition required by applicable program, lease and local requirements.

Cooperate

Cooperate with required inspections and PHA procedures.

Document

Maintain appropriate leases, notices, repair records and financial records.

Follow the Law

Follow applicable fair-housing, landlord-tenant and nondiscrimination requirements.

Before You Buy

Your landlord checklist should begin before closing on the property.

Identify the PHA

Determine which housing authority actually serves the property.

Obtain the Landlord Packet

Get the current forms and procedures directly from that PHA.

Verify Payment Standards

Review the correct bedroom-size and geographic standards.

Review Utilities

Understand utility responsibility and applicable allowances.

Understand Inspections

Know what inspection system and procedure the local PHA currently uses.

Analyze the Property

Never substitute program eligibility for actual investment analysis.
